Senator Langerholc offered amendment A01328 which will remove the inclusion of 13(a)(12) of the Controlled Substance, Drug, Device, and Cosmetic Act which is “the acquisition or obtaining of possession of a controlled substance…” The sentencing enhancement would now only apply to 13(a)(14) and 13(a)(30), which are related to the delivery of a controlled substance. The amendment was agreed to by a voice vote. The bill was approved by a vote of 43-7.
SB 739, PN 1006 (Pennycuick) – Amends Title 18 (Crimes and Offenses) to prohibit the manufacture, distribution, sale, transfer, use or possession of illicit devices for motor vehicles, and prohibiting aiding or permitting another person to use an illicit device, graded as a first-degree misdemeanor for the first offense. Failing to report a lost or stolen illicit device to law enforcement within 48 hours will result in a summary offense and minimum $250 fine for the first offense. A vote of 49-1 was recorded.

Senator Boscola offered amendment A01351 which amends the section on private cause of action and encampments on public property. Senator Langerholc moved to table the amendment. The motion passed by a vote of 27-23. The bill was approved by a vote of 34-16.
HB 799, PN 823 (Deasy) – Amends Title 51 (Military Affairs) to require employers with a worksite in Pennsylvania at which 50 or more employees are employed must display a DMVA-created posting with information related to veterans’ benefits and services. The DMVA must create, and employees must comply, by the 60-day effective date.
Senator Mastriano offered amendment A01327 which adds an employee accessible website as an option for an employer to display the workplace posting. The amendment adds that the effective date for the department requirements is 90 days and the employer requirement to display the workplace posting is 180 days. The amendment was approved by a vote of 48-2. The bill was re-referred to the Appropriations committee.

Senator Baker offered amendment A00410 which
- Adds language to the definition of “oral communication” in Title 18 clarifying that to intercept communication inside the residence of an employee of DOC the employee must consent or obtain prior court approval.
- Adds the requirement in Title 61 (Prisons and Parole) that upon being granted parole, a individual must be provided written notice that any communication made in front of a parole agent may be intercepted.
Please note that the amendment will take the ACLU-PA from opposed to neutral on the bill.
