Banking & Insurance 2019-2020

The Senate Banking & Insurance Committee met on Monday, September 21, 2020, and voted on the following:

HB 858 (Brown) – Authorizing certain financial institutions to conduct savings promotion programs; and providing for enforcement by the Department of Banking and Securities.

HB858 was moved by Senator Scavello, seconded by Senator Phillips-Hill, and reported as amended by a vote of 14-0. Amendment A07220 was adopted unanimously.

HB 1769 (Mackenzie) – Amending the Charitable Gift Annuity Exemption Act to define “de-risking annuity contract”.

HB1769 was moved by Senator Scavello, seconded by Senator Street, and reported as committed by a vote of 14-0.

The committee went over the following two bills:

SB 1229 (Laughlin) – Amending The Insurance Company Law of 1921, in general provisions relating to insurance companies, associations and exchanges, further providing for service contract exclusion.

SB 903 (Mensch) – Amending the act of October 16, 1996 (P.L.712, No.127), known as the Charitable Gift Annuity Exemption Act, further providing for definitions.



The Senate Banking & Insurance Committee met Tuesday, June 30, 2020 and voted on the following:

HB1439 (Kaufman) – Amends Title 40 (Insurance) requiring certification of compliance by an insurer with federal and state law governing mental health parity.

HB1439 was moved by Senator Scavello, seconded by Senator Street, and reported as committed by a vote of 13-1.

HB1696 (Murt) – Amends Insurance Company Law (Act 284 of 1921) to require insurers to conduct analyses and ensure availability to the Insurance Department detailing mental health parity compliance.

HB1696 was moved by Senator Scavello, seconded by Senator Street, and reported as committed by a vote of 13-1.


The Senate Banking & Insurance Committee met Wednesday, June 10, 2020 and voted on the following:

SB1195 (Scavello and Street)Amending the act of May 17, 1921 (P.L.682, No.284), known as The Insurance Company Law of 1921, in Life and Health Insurance Guaranty Association, further providing for purpose, for definitions, for coverage and limitations, for creation of association, for board of directors, for powers and duties of association, for assessments, for plan of operation, for powers and duties of the commissioner, for prevention of insolvencies, for credits for assessments paid, for miscellaneous provisions, for examination of the association and annual report, for immunity, for stay of proceedings and reopening default judgments, for prohibited advertisement or Insurance Guaranty Association Act in insurance sales and for prospective application.

SB1195 was moved by Senator Scavello, seconded by Senator Street, and unanimously reported out of committee.

HB1457 (Schroeder) – Amending the act of May 17, 1921 (P.L.682, No.284), known as The Insurance Company Law of 1921, in casualty insurance, further providing for mastectomy and breast cancer reconstruction.

HB1457 was moved by Senator Scavello, seconded by Senator Pittman, and unanimously reported out of committee.


The Senate Banking and Insurance Committee met on Tuesday, November 19, 2019, and took action as follows:

SB 595 (Mensch) The bill amends the Insurance Company Law of 1921 to further provide for coverage for mammographic examinations. The bill requires coverage of MRI and Ultrasound as an alternative to mammograms for breast cancer screenings under certain conditions. The bill was reported out unanimously.

HB 427 (Benninghoff) The bill provides for health insurance coverage requirements for stage four, advanced metastatic cancer. The bill was reported out unanimously.


The Senate Banking and Insurance Committee met on Monday, October 28, 2019 and took action as follows:

SB 857 (Vogel) The bill authorizes the regulation of telemedicine by professional licensing boards; and providing for insurance coverage of telemedicine. The bill was reported out by a vote of 13-1.


The Senate Banking & Insurance Committee met Monday, June 24, 2019 and took the following action:

SB857 (Vogel) – An Act relating to telemedicine; authorizing the regulation of telemedicine by professional licensing boards; and providing for insurance coverage of telemedicine.

Senator Vogel introduced amendment A03486 which changes the definition of “Health care provider,” Participating Network Provider,” and “Store-and-Forward Technology.” It specifies that licensure board regulations shall not establish a separate standard of care for telemedicine, but requires health care providers to direct patients to seek in-person care when the use of telemedicine would be inconsistent with the standard of care. The amendment was approved by a vote of 13-1 and the bill was reported from committee as amended by a vote of 13-1.
