SB 194, PN 135 ( Folmer)- Amends the Medical Care Availability and Reduction of Error (MCARE) Act to repeal the requirement that the Insurance Department prepares an annual Medical Malpractice statistical report. The Committee reported the bill out as committed on a vote of 14-0.
SB 371, PN 294 ( Brubaker)- Repeals the Savings Association Code of 1967, eliminating provisions for incorporation and organization, for names, for offices, for directors, officers, employees and attorneys, for members, for corporate powers, for savings operations, earnings, account insurance and reserves, for investment operations, for amendment of articles, for mergers, consolidations, conversions and reorganizations, for voluntary and involuntary dissolution and distribution of assets upon insolvency, for foreign and Federal associations, for provisions applicable to Department of Banking and for penalties and criminal provisions. The Committee reported the bill out as committed on a vote of 14-0.
SB 380, PN 313 (Eichelberger)-Amends Title 13 (Commercial Code) of the Pennsylvania Consolidated Statutes, in transfers of funds, further providing for exclusion of consumer transactions governed by Federal law; and making an editorial change. The Committee reported the bill out as committed on a vote of 14-0.
SB 381, PN 314 ( Eichelberger)- Amends Title 13 (Commercial Code) of the Pennsylvania Consolidated Statutes, to update provisions related to secured transactions. The Committee reported the bill out as committed on a vote of 14-0.
SB 379, PN 302 ( Vance)- Amends the Insurance Company Law of 1921, adding provisions relating to medical professional liability insurance; and further providing for the expiration of children’s health care provisions. A motion to table offered by Senator Stack for the purpose of holding a public hearing failed on a mostly party line vote of 10 to 4. Senator Stack offered the following four amendments: Amendment 00103 – This amendment removes the language “or admission” from page 3 of the bill. It leaves the benevolent gesture language in place. Amendment 00115 adds language that says statements of fault, negligence, and culpable conduct may be admissible in a medical malpractice trial. Amendment 00104 – Removes the expiration date on CHIP. Amendment 00102 – Removes all of the benevolent gesture language and keeps the language for the 5 year CHIP. All four amendments failed on mostly a party line vote of 10 to 4. The Committee reported the bill out as committed on a vote of 10 to 4.
